These terms govern your use of the VioLearning platform provided by Vio Learning Ltd ("we", "us", "our"). By accessing or using VioLearning, you agree to these terms.

1. About VioLearning

VioLearning is an AI-powered educational platform designed for UK secondary schools. It provides tools for teaching, assessment, progress tracking, and personalised learning across multiple subjects.

2. Partner School Programme

During our partner school testing phase, access to VioLearning is provided free of charge to selected partner schools. Partner schools agree to:

  • Provide feedback on the platform to support its development
  • Use the platform in accordance with these terms
  • Ensure appropriate consent is obtained for student data processing
  • Designate a point of contact for communication with Vio Learning

3. Accounts and Access

  • Teacher and administrator accounts are created by Vio Learning or a school administrator
  • You are responsible for maintaining the confidentiality of your login credentials
  • You must not share your account with others
  • You must notify us immediately of any unauthorised use of your account

4. Acceptable Use

You agree to use VioLearning only for legitimate educational purposes. You must not:

  • Use the platform for any unlawful purpose
  • Attempt to gain unauthorised access to any part of the platform
  • Interfere with or disrupt the platform's infrastructure
  • Upload malicious content or attempt to exploit AI services
  • Use the platform to process data for purposes other than those agreed with your school

5. Intellectual Property

The VioLearning platform, including its design, code, AI models, and content, is owned by Vio Learning Ltd and protected by copyright and other intellectual property laws.

Content created by teachers using the platform (lessons, assessments, etc.) remains the intellectual property of the teacher or their school.

Student work remains the property of the student and their school.

6. AI-Generated Content

VioLearning uses artificial intelligence to generate educational content, assessments, scores, and feedback. While we strive for accuracy:

  • AI outputs are tools to assist teachers, not replacements for professional judgement
  • Teachers should review AI-generated scores and feedback before sharing with students
  • We do not guarantee that AI outputs are error-free

7. Data Protection

Our handling of personal data is governed by our Privacy Policy. Key commitments:

  • All data processing occurs within UK infrastructure (Azure UK South)
  • We act as a data processor on behalf of schools
  • We do not sell or share personal data with third parties for commercial purposes
  • We comply with UK GDPR and the Data Protection Act 2018

8. Service Availability

We aim to provide a reliable service but do not guarantee uninterrupted access. We may occasionally need to suspend the service for maintenance, updates, or security reasons. We will endeavour to provide reasonable notice of planned downtime.

9. Limitation of Liability

To the fullest extent permitted by law:

  • VioLearning is provided "as is" during the partner school programme
  • We are not liable for any indirect, consequential, or incidental damages
  • Our total liability is limited to the fees paid (if any) in the 12 months preceding the claim

Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

10. Termination

  • Either party may terminate the partnership by providing 30 days' written notice
  • We may suspend access immediately if these terms are breached
  • Upon termination, we will delete school data within 90 days, unless retention is required by law
  • We will provide a data export upon request before deletion

11. Changes to These Terms

We may update these terms from time to time. Material changes will be communicated to partner schools at least 30 days in advance. Continued use of the platform after changes take effect constitutes acceptance of the updated terms.

12. Governing Law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
